Why witnesses in Jamal’s murder case could jeopardize justice

The family of the former Vioja Mahakamani actor, Jamal Nassul Gadafi may never get justice as witnesses in the murder case have failed to cooperate.

Mr. Gadafi was allegedly stabbed to death by his girlfriend Grace Kanamu Namulo at a Machakos hotel on the night of December 11 after quarrelling over love-related issues. Charges are now yet to be pressed against the 41-year old businesswoman who is the key suspect in the killing of Gadafi.

Ms. Namulo was yesterday arraigned in a Machakos High Court where, for the second time, charges were not read to her because “three key suspects in the case are yet to file their testimonies”.

Deputy Registrar Kenei said that the evidence was yet to be submitted by the three crucial witnesses. Ms. Kenei further said that the witnesses went missing after the incident.

Ms Namulo, who had initially been detained for five days will now remain in police custody for another eight days as the prosecution gathers enough evidence to charge her in court.

The suspect’s lawyer, Cliff Ombeta, said that his client was not opposed to investigations being conducted adding that she only  wants the probe done while she is free on bond.

The Magistrate in the case had earlier stated that the Director of Public Prosecution had requested for more time to conduct thorough investigations.

“Having found that [there was no malice by the DPP’s request], this court is inclined to grant the applicant eight days to conclude the investigations,” said Ms Kenei.

However, lawyer Cliff Ombeta denied the allegations that his client would interfere with witnesses. In his argument, Ombeta said that Grace did not know the names of the key witnesses and therefore, it would be hard for her to interfere with them.

Mr. Ombeta also requested that he be supplied with witness statements.

The case will be mentioned on December 27.
