Prisoners march to court to fight for their right to vote

In an appeal to a previous ruling, Kenyan prisoners want the court to allow them to fully participate in general elections.

This comes as the inmates had earlier made an appeal to be allowed to vote, but the court only restricted them to voting for the president alone.

The previous case, filed by Kituo cha Sheria court directed the Independent Electoral and Boundaries Commission(IEBC) in 2013 to put in place measures to ensure that prisoners are registered to vote, and are able to vote in General Elections.

However, the electoral body complied but limited prisoners voting to the presidential vote only.

This also affected prison officers who had registered as voters within the prison facilities and, therefore, voted in the presidential election only.

The inmates have now made a court application, led by Aloise Onyango Otieno, a Kamiti prisoner, who filed the application.

He on behalf of fellow inmates, said they seek to be allowed to vote for Members of the County Assembly, Members of Parliament, Members of Senate, Women Representatives, and Governors.

“We urge the court to compel IEBC to register prisoners to vote in all the elective seats in the 2022 General Elections. IEBC should also be compelled to print ballot papers for all the five positions,” Mr Onyango stated in court papers.
