They say there is always light at the end of the tunnel and true to this one Joy Gwendo has certainly seen light.
From a woman meant to spend two years behind bars for fraud, Gwendo is now all smiles after the Courts granted her freedom.
High Court found issue with the trial Court’s decision to sentence the former Senator to two years imprisonment without giving her option for a fine or bail.
The High Court has therefore quashed Gwendo’s previous jail term for her 1.7 million fraud.
The High Court has therefore ordered that Gwendo be Sentenced afresh.
Justice John Onyiego indicated that the trial court erred in law in sentencing her to jail without the option of a fine.
“Sentencing is a discretion of the trial court but the sentencing imposed should not be illegal. I find that it was improper for the trial court to impose a jail term without the option of a fine,” he said.
