Miguna Miguna All Smiles After Latest Landmark Ruling See Him Vindicated

Self Declared NRM General’s rights were violated, the High Court has ruled.

High Court Judge, Justice Chacha Mwita Court has also ruled that Miguna Miguna is a Kenyan Citizen and not a Prohibited Immigrant like the government had purported.

The Court has found the government in violation of Miguna’s rights after arresting him and taking him to Kiambu but failing to produce him in Court within 24 hours.

The Court has also established the Miguna was held incommunicado and deported unlawfully outside the country.

Miguna has therefore been awarded 7 millions shillings in damages for the violation of his rights with the Court ordering that the respondents in the case, Interior CS Fred Matiangi and Principal Secretary State Department of Immigration, Border Control & Registration of Persons General Kihalangwa bear the costs.

Miguna has also been awarded 270,000 for damages on his property.

Lawyer Miguna Miguna had sued the government, seeking unrestricted entry into the country following a visa debacle.

In the lawsuit filed by his lawyers Nelson Havi, John Khaminwa and Julie Soweto back in March, Dr Miguna also wanted court to block his deportation.

He sued Interior Cabinet Secretary Fred Matiang’i, Inspector General of Police Joseph Boinett, Immigration director Gordon Kihalangwa, Director of Criminal Investigations George Kinoti and the Attorney-General, among others.

Dr Miguna rejected the government’s attempts to deport him to Dubai, United Arab Emirates.

The government rejected Dr Miguna’s return to Kenya and attempted to re-deport him to Canada after a nine-hour stand-off at JKIA.
