In a statement released on Tuesday morning, the Haji has stated that he was entirely satisfied that the actions by the two warrant their prosecution in relation to Monica Kimani’s murder.

The DPP directed that Ms Maribe and Irungu are immediately arraigned before the High Courtand charged for violating section 203 and 204 of the Penal Code.

I have independently reviewed the evidence so far on record and am satisfied that there exists a prima facie case to warrant criminal prosecution against the following individuals, for the offence murder contrary to section 203 as read with sections 204 of the Penal Code,” stated Haji, listing Joseph Irungu and Jacque Maribe in the announcement.

Section 203 of the Penal Code states that any person who of malice aforethought causes death of another person by an unlawful act or omission is guilty of murder.

In earlier stages of the probe, DCI George Kinoti confirmed that the evidence gathered in the case had implicated that Maribe was indirectly involved.

Section 222 of the Penal Code Accessory states that any person who becomes an accessory after the fact to murder is guilty of a felony and is liable to imprisonment for life.

The Citizen News anchor’s car is reported to have been used by Joe Irungu, who is the main suspect, on the night Monica was killed.

Ms Maribe’s neighbour, Brian Kassaine, and other suspects in police custody over Ms Kimani’s murder on September 19 at Lamuria Gardens have been left out.

This means Kassaine will be a State witness in the case against the couple who are expected in court today, Tuesday, 9. October 2018.
