The High Court has declared the appointment of 50 Chief Administrative Secretaries (CASs) by President William Ruto as unconstitutional. The decision came in response to a petition filed by the Law Society of Kenya (LSK) and Katiba Institute, who challenged the appointment process.

The court ruled that the creation of the CAS positions did not comply with the constitutional requirement of public participation. While public participation was conducted for 23 CASs, the appointment of the additional 27 CASs did not adhere to this requirement.

Consequently, the court invalidated the appointment of all 50 CASs. These appointments were made by President Ruto on March 23 after the National Assembly declined to vet them, citing a lack of constitutional authority to do so.

Azimio leaders, including Raila Odinga, have expressed their approval of the High Court’s ruling that declared the appointment of 50 Chief Administrative Secretaries (CASs) by President William Ruto as unconstitutional. They welcomed the decision, stating that it would help reduce the country’s wage bill and save Kenyans from unnecessary expenses.

Azimio leaders also pledged to hold the government accountable and ensure the protection of Kenyans from irrational political decisions.
