Nyamira County MCAs have been warned by the industrial court against impeaching the County executive.
Mr. Bernard Osumo, the minister of Public Service Management, served the orders to the assembly on Thursday, a move that could give him a temporary reprieve.
“You’re hereby ordered not to interfere, discuss, summon or impeach the applicant, Mr. Bernard Osumo until a matter raised is heard and determined by this court,” read the orders from Justice Nduma Nderi.
MCAs had unanimously supported a motion targeting Mr Osumo’s removal.
Osumo is facing abuse of office, gross misconduct, and misappropriation of funds charges. He’s accused of failing to pay Sh24 million to six workers who were seconded by TSC to Nyamira.
Leader of Majority Duke Masira dismissed the order urging that the court lacks jurisdiction to petition the assembly.
“We have received orders but this will not stop us. We must protect the people of Nyamira and their resources. Courts cannot subvert justice. We are an independent institution,” he argued
The County executive is a close associate to Raila Odinga.
