Maryanne Kitany will next month know if divorce case against Mithika Linturi will proceed to a full hearing. Ms. Kitany is seeking the dissolution of her marriage to Linturi, who is the senator for Meru county.
Linturi, however, countered saying that he and Kittany were never married. He, therefore, wanted the divorce proceedings terminated.
On Wednesday, Linturi, through his lawyer Muthomi Thinakolu, told Chief Magistrate Peter Gesora that has been married to only Mercy Kaimenyi, in a monogamous arrangement.
However, Kitany, through her lawyer Danstan Omari, told the court that Linturi and Ms. Kaimenyi were never married. She said that documents purporting to show the existence of a marriage between the two were forgeries.
Ms. Kitany said she and Linturi got married and even held a ceremony in Meru. She produced photographs she said to demonstrate that a marriage ceremony took place. But Linturi argued that photos can’t be conclusive in demonstrating that a marriage took place.
The ruling on Mitheka’s application will be delivered on May 29.
