Why the government will be forced to delay house Levy

Another rock has hit the government’s housing fund levy, as the Federation of Kenya Employers (FKE) is battling its implementation.

In a statement, FKE said that court orders suspending the implementation of the levy is still on, up to May 20, 2019, when the case will come up again for mention.

“The Federation of Kenya Employers (FKE) attended Court on April 8, 2019 for the further mention of this case and obtained an extension of the Court Orders suspending the implementation of the Housing Levy up to the 20th of May 2019 when the case will come up again for mention for further directions from the Court on the Hearing and determination of this case,” the statement reads in part.

In a newspaper advertisement on Tuesday, the Housing ministry and the Kenya Revenue Authority announced that the housing fund levy “has come into effect”, meaning every employed Kenyan must remit 1.5 percent of their basic salary for April to the National Housing Development Fund.

This is in line with the Finance Act 2018, where the total amount contributed shall not exceed Ksh5,000.

Lawyer Nelson Havi has stated that the government’s disregard of the rule of law and disobedience of court orders, the highest form of corruption in Kenya.

“GoK cannot win the war on corruption when it perpetrates it. It is that simple,” he stated.
