How Social Media Records Can Help you Win Court Cases in Kenya

Anytime you sense you are in trouble or just about to get into trouble, make a quick decision to create a record of the time and you keep it. This is how you do it.

As soon as you have been arrested, or as soon as your car has been hit…etc, send text messages (preferably an inbox message) to a trusted friend or relative or two, giving key details of the incidence. Give sufficient information. Then keep the message and any other subsquent chat on it. If possible photos as well.

The idea is not just to pass the message but to have a permanent, reliable, unquestionable record of the date and time of the event. The date and time reflected on the text shuts down any other contrary evidence.

One of the many evils that happen in police stations is cooking up of evidence and documents and giving them dates and times without thinking logically.

Some of the dates and timelines either make or break a case. There are about 3 cases where police officers say in their statements that certain crimes happened on specific dates and time yet the dates they give do not reflect the true picture of the happenings.

Even the OB reports and in charge sheets and investigation diaries. Yet my clients have clear messages indicating they were already discussing the arrests days before. It’s just carelessness in the investigations.

When you confront the police officer in court, it’s his word against the Safaricom timelines and your guess is as good as mine.
