Court cuts governor’s 100 million bail term, terms it ‘excessive’

Following concerns over the High Court’s bail terms on Samburu Governor Moses Lenolkulal, the court decided to cut the bail by ten percent.

Justice Mumbi Ngugi changed the 100 million bail to 10 million as the initial terms were said to have purported that the accused was already guilty even before trial.

The judge further directed the governor to deposit and alternative bond of Sh30 million with a surety of similar amount to secure his freedom from custody.

β€œIt is my view that bond terms imposed on the applicant are excessive and may well amount to denial of bail. It has not been demonstrated that he is flight risk and I note the prosecution did not oppose his application for bail,” she ruled.

Justice Ngugi however insisted that the remaining orders of the trial court shall remain in force pending hearing and determination of a petition by the Director of Public Prosecutions.
