Nominated Makueni MCA charged with ethnic contempt

Makueni County Assembly nominated MCA Mbula Mutula was on Monday arraigned in court for a post she allegedly made in her Facebook page during 2017 repeat of presidential polls.

The post is said to contravene the National Cohesion and Integration Act.
Mbula presented herself to the National Cohesion and Integration Commission (NCIC) offices in Nairobi on Monday accompanied by her lawyer where she was questioned.

This after engaging officers from the Directorate of Criminal Investigations in a game of hide and seek after they went to arrest her at the County Assembly premises last week.

The officers camped at the Assembly chambers last Thursday night hoping to arrest the MCA not knowing that she had been whisked away by her colleagues.

Mbula was then ferried to Makueni law courts where she appeared before Senior Principal Magistrate James Mwaniki.

The court heard that on November 19, 2017, while at unknown place, the accused through her Facebook account wrote that “Mungiki in police uniform were slaughtering NASA supporters mercilessly…….”

Further, the particulars of the offence implicated that a certain Kenyan tribe was cursed and they should be chased from certain Kenyan regions and their businesses boycotted.

Prosecutors argue that the post was irresponsible and could cause ethnic hatred towards a certain tribe and Kenyans by extension.

She has denied all the charges labeled against her saying they are lies and released on a bond of Ksh 800,000 and surety of a similar amount or pay a cash bail of Ksh 400,000.

The case will be mentioned 15, and hearing will commence 28 next month.
