Subversion of Justice? Secret Meeting between EACC and NLC Bosses Raise Eyebrows

Micheal Mubea, the deputy EACC boss and Kabale Tache, the acting National Land Commission CEO held a secret meeting on Thursday afternoon, in what observers say is a case of subversion of justice.

The two were spotted huddled in a corner of Java restaurant in upscale Lavington.

They appeared to be in serious discussion only a day after it emerged that NLC directors had demanded that EACC investigate Kabale and two other senior officials at the commission for abuse of office.

The NLC want Kabale, vice chair Abigael Mbagaya and Human resources Director Ben Bett probed.

The directors have filed a petition to the Solicitor General Kennedy Ogeto and the EACC.

The two were in the restaurant for roughly one hour. Kabale was the first to arrive at about 3pm. She took the corner table and Mubea joined her after 30 minutes.

Kabala took a smoothie while Mubea sipped mixed tea. After about one hour, Mubea stood and left. Kabale followed him out after five minutes.

Through Chimei and Company Advocates, the directors have accused Mbagaya, Kabale and Bett of committing illegalities, breach of the Constitution, abusing their powers, exposing the commission to public liability and for propagating institutional crisis.

“By copy of this letter, we ask your office to urgently intervene to save NLC and to abridge runaway never mind the law and the Constitution attitude which may turn out to be very costly to the commission and the public when the present term of the commission comes to an end on February 19, 2019,” Chimei said.

Deputy solicitor general Njeri Wachira on behalf her boss Ogeto, wrote to Mbagaya and Kabale asking them to furnish the solicitor general with details on the “illegal” employment of 21 officers.

Wachira said they had received complaints that NLC has recruited staff without due process, and there have been no sittings to approve the hiring.
