Heavy offences that saw Judge Mutava lose his powerful position

They say what goes round comes back around. It may take years but eventually demons start to haunt those used in black missions inviting crippling chaos.

It has been revealed that the main reason that led to the removal of High Court Joseph Mutava was his ruling in the Goldenberg scandal involving Kamlesh Pattni, a newsroom reports. 

Justice Mutava was removed from office following the tribunal’s recommendation to President Uhuru Kenyatta in 2016.

The Maraga-led tribunal heard 29 witnesses and the judge’s lawyers and found that Mutava had colluded with others to gain access to a file in a suit where he was under investigation.

The judge was further found guilty of proceeding to write a ruling on the matter in a bid to influence its outcome.

Mutava terminated all cases against the controversial billionaire Kamlesh in March 2013.

He also stopped investigating authorities from charging the businessman with any offence relating to the Goldenberg scandal where taxpayers lost Ksh 5.8 billion.  

Mutava further ruled that Pattni would not get a fair trial since the case had been prolonged and some of the witnesses had died.

He declared that there was no complainant to warrant pursuing the case since Pattni had agreed to surrender the Grand Regency Hotel and returned Treasury Bills. 

The businessman had been in the dock since 1994 when he was accused of being behind one of Kenya’s biggest thefts of the public coffers.
