Gichuru, however, denied the charges and was freed on a Kshs 200,000.

The case had earlier been referred to Karatina senior resident magistrate MukhayeNjalal who declined to hear it citing conflict of interest.

Apparently, the house that the student broke into was located in the same compound as that of the magistrate.

Delivering her ruling, Kosgei also ordered that the suspect be taken to a hospital since he had a swollen face and complained of being assaulted by the officer.

This comes nearly a month since Inspector General of Police Joseph Boinnet issued special orders calling for the arrest and consequent charging of any civilians donning attire resembling police or military uniform.

Communication from the National Police Service cited that this type of clothing, when worn by ordinary citizens, creates confusion among members of the public.

The case is set for hearing on March 6.
