Cases of botched Surgical operations and misdiagnosis in the Kenyan Hospitals have lately been on the rise with a case seemingly being reported every month.

Some of these mistakes that could at times be avoided by our medical practitioners have at times had a heavy toll on the affected parties.

Some patients have gone blind, others paralysed, some mad while extreme cases have even led to death.

So what is the way foward? How best should Medical negligence be dealt with and avoided in the country?

Well, many are the times that the Kenyan Courts have been called in to help solve this matter with a number of cases still pending in court with regards to the same.

A woman who suffered uterus perforation in the hands of medical practitioners at Matter hospital joined the long list of Kenyans who had the Courts come to her rescue after she was awarded 2.4 million as compensation.

The woman had sued Mater Hospital for negligence

In her ruling, senior resident magistrate P Muholi said the injuries suffered by Betty Wakio were not beyond control of Mater Hospital.

Muholi said she is not convinced by the explanation that the woman had had an incomplete abortion before visiting the hospital.

The magistrate said prior to the hospital visit, the woman did not have a perforated uterus and ileum.

According to court papers Wakio on September 13, 2013, visited KNH to see a gynaecologist but was referred to Mater Hospital.

It emerged that she had suffered miscarriage which led to evacuation, she said.

After the evacuation was done she felt severe pain which she said forced her to go back to the hospital five days later.

A CT scan was done which showed that she had a perforated uterus.

But the hospital said the woman had lost many pregnancies and had to undergo evacuation at different hospitals at least twice.

It also said the medical attention the woman was given was proper.
