Basic salary levy gets CS Henry Rotich & James Macharia in a serious lawsuit

The big four agenda is no joke, several plans are being rolled out despite all odds and opposition facing them.Some of the feuds regardingdevelopment have heated up in away that they even caused discontent between the president and his faithful followers.

With regards to housing agenda, a while back the High Court in Nairobi temporarily suspended the 1.5 per cent National Housing Development Fund, set to be levied on all salaried workers.

Cotu had gone to court to challenge the Government’s decision to levy workers in a bid to finance the ambitious housing project.

The trade union said deduction of 1.5 per cent of employees’ basic salaries will force people into servitude, resulting in widespread public discontent.In an affidavit, Cotu Secretary General Francis Atwoli argued that sections of the Act require a serious public debate to enable stakeholders understand the implications of the provisions.

Well once again National Treasury Cabinet secretary Henry Rotich and his Transport counterpart James Macharia have been sued over the 1.5 per cent housing development levy.

Bomet Savannah Enterprises Limited, Paul Cheruiyot Sigei and Salina Jerop Kipkorir want the court to stop the government on imposing the levy from salaries of employees. According to the petitioners, imposing 1.5 per cent levy on the basic salary of employees is against public policy.

The petitioners argue that the decision was arrived at without public participation. Through lawyer Nyaboga Mariaria, they want the court to declare the imposed implementation unconstitutional and, therefore, null and void.

The petitioners are seeking an order suspending the implementation of Section 31A of the Employment pending the hearing of the suit.
