Supreme Court upholds election of James Lusweti as Kabuchai MP

James Lusweti Mukwe can now breathe a sigh of relief after the Supreme Court upheld his election as the Kabuchai Constituency Member of Parliament.

In their ruling, the judges overturned the Court of Appeal ruling nullifying his election saying he was validly elected.

This comes after the Appellate Court sitting in Kisumu on July 26, 2018 nullified the parliamentary results following a successful petition by Edward Tale Nabangi.

Lusweti aggrieved by the decision by Appellate judges Erastus Githinji, Hannah Okwengu and Jamila Mohamed then moved to the Supreme Court.

Luwsweti was declared winner with 18,485 votes against Nabangi who polled 18,062 votes in the August 8, 2017 general election.
