CJ Maraga sends stern warning to Judges and Magistrates over cases adjournment

Chief Justice David Maraga has directed  all judges and magistrates not to adjourn any court proceedings  or  wait for any lawyer in particular cases citing delays in hearings and rulings.

Speaking at Bomas of Kenya during the anti-graft  summit, Maraga says the delays are created by lawyers who have so many cases and in turn choose to  deliberately attend to them selectively.

According to  Maraga the accused must now be ready to have  other lawyers who will represent them fully  and on time failure to which the cases will proceed without their absentee lawyers.

‘’We have all these delays because of lawyers who want to attend to each and every case half –way, and as the Judiciary we are not going to work  with the  lawyers’ schedule  but own schedule.’’ He added.

He further asked the investigative bodies (Directorate  of criminal investigation department ,Ethics and anti-corruption commission) to present tangible and concrete evidence  for the corruption suspects to be jailed.

Justice Maraga, also  targeted the directorates of public prosecution and criminal investigations.

“We are not going to win the war against corruption by Friday arrests… I do not want to appear like I am in a blame game but let the truth be told! The judiciary does not go out there to look for cases; those who feel aggrieved come to us and file cases,” said the CJ.

“The war against corruption will not be worn by blame-games and by people who are involved here (some are here) hiring professional bloggers to demonise anybody and the Judiciary.”
