Embakasi East Member of Parliament Babu Owino has pulled through an election petition after Supreme Court upheld Court of Appeal ruling that he was validly elected as Embakasi East MP.
The court of Appeal had on June 8, 2018 overturned High Court’s nullification of his August 2017 election.High Court’s Justice Joseph Sergon had nullified his election citing massive electoral malpractices.
A recount of votes cast in the 2017 Embakasi East parliamentary election showed that embattled Member of Parliament Babu Owino won the disputed contest.
The report, filed in court by the deputy registrar , February 26 showed that after the recount, Babu Owino got 46,817 votes against the petitioner, Francis Mureithi, who garnered 42,501 votes.
According to the report, both Babu Owino and Mureithi registered an increase in votes after the recount was done.
A reenergised Babu Owino now believes it is time to serve his electorates as he reaffirmed his trust in the Judicial processes of the country.
Mureithi, who was represented by lawyer Ham Lagat and Kiragu Kimani, had filed an application for scrutiny and recount of votes cast during last year’s election.
