Miguna Miguna hints that 7 Million Award will not restore all his loses

 

Miguna Miguna has today  insisted  on full compliance to the court ruling by the ‘despots’: making demands for  the delivery of his valid Kenyan passport, payment of the damages and costs and no repeat of the violations so that he can go on with his life unimpeded.

Miguna Miguna has today said that he always asserted his irrevocable rights to life, fair hearing, bodily integrity, dignity, citizenship, passport, protection against torture, as well as his freedoms of conscience, speech, association and mobility.

“Those are the rights Justice Mwita restored and affirmed.” he added

The orders Justice Mwita made are meant to restitute for the injuries President Uhuru Kenyatta and his surrogates have inflicted on him.

He however adds that no matter how much anyone is awarded in damages, it will never restore the physical, emotional, repetitional and financial loses any party has suffered.

According to the lawyer, courts only send messages of deterrence and symbolic restoration in judgments and orders.

“When anyone goes to court, he or she seeks specific orders from the court. I did. I presented credible evidence and relied on relevant case law, provisions of the constitution and statutes.” reads tweet

Miguna Miguna also revealed that despots did not tender any evidence and did not even respond to his affidavit.

They conceded all the factual assertions he made. The Court considered the evidence and facts he presented and found them credible.

He links the failure of the  despots to the claims that they told stories through lawyers with zero evidence.

In his ruling, Justice Chacha Mwita awarded Miguna Kshs7 Million for violation of his rights adding that citizenship by birth could not be revoked.

Interior CS Fred Matiang’i and Immigration PS Gordon Kihalangwa have been ordered to personally pay the money to deter such actions by ‘overzealous’ state officers.

The court further ordered he be issued with his Kenyan Passport and ruled his handling as the worst form of human rights violation

The lawyer has since thanked those who stood with him in solidarity and plans on revealing the date he will jet back in the country.
