Senior Counsel, Ahmednasir Abdullahi has over the last two hours come to the defense of two National Hospital Insurance Fund (NHIF) big shots, Chief Executive Officer Geoffrey Mwangi and Chief Finance Director Wilbert Kurgat.
The two NHIF bosses were arrested and arraigned in court facing charges of conspiracy to obstruct justice and disobedience to lawful orders.
Only yesterday, court documents revealed that a text message from Mr. Geoffrey Mwangi to the Mr. Wilbert Kurgat directed Kurgat not to share any documents demanded by the investigators.
According to the police, the text message was crucial in the investigation about fraudulent transactions that were made.
However, Lawyer Ahmednasir has termed the investigation as an infringement of rights and a total waste of time.
“Basing criminal prosecution on an alleged sms sent through a private mobile accessed by the police in total contravention of the constitutional right to PRIVACY is unsustainable and inadmissible and is total waste of time and resource..such a case will be thrown out in limine…” said Mr. Ahmednasir.

The lawyer further said that the charges facing Mr. Geoffrey Mwangi are conspiracy attack to remove the MD from office.
I don't know this MD for NHIF…but charging him with obstruction of justice is an obvious transparent strategy to remove him as MD…the politics of the healthy ministry is getting very silly…

In a court session yesterday, the prosecution claimed that the two denied officers access to documents such as payment vouchers and other books that were considered important to the investigation relating to payment of millions of shillings to Webtribe Ltd, a firm dealing in online payments.
