“Sheria pana tambua mheshimiwa!” homabay MCAs reappear in court for fresh charges a day after release

One charge after the other?? This is what Homabay County Assembly members have gone through! Barely a day after being released from remand at Kodiaga Prison, honourable members found themselves in the hands of the la once more.

The two  MCAs have now been charged with assaulting a court server.

Julius Gaya and Philomen Onditi who were nabbed on Tuesday evening appeared before a Kisumu court on Wednesday.

They however pleaded not guilty to assaulting Elvis Ochieng’ on November 14. The latter was from Kisumu High Court.

He says the county legislators assaulted him as he sought to serve Clerk Joseph Kaudo with a contempt order.

The order was to summon the clerk for allegedly allowing the swearing in of Gwassi North MCA Evans Marieba as acting speaker.

He avers that the MCAs, who were from a sitting, pounced on him with kicks and blows accusing him of meddling.

Ochieng sought refuge at Homa Bay police station while his driver fled to avoid being attacked by the MCAs.

Principal magistrate Christopher Yalwala released the lawmakers on Sh50,000 bond each or Sh20,000 cash bail.

Lawyer Agrey Mwamu, for the MCAs, requested that the county reps be released on bond.

He said the duo were released on bond on a similar case of assault. Prosecutor Lazurus Sirtui did not object the request.

The matter will be mentioned on November 30, the same day Speaker Elizabeth Oyoo assault case will be mentioned.

Homa Bay county assembly has had wrangles since the ouster of former majority leader Richard Ogindo.

The wrangles also culminated to the impeachment of Ayoo. However, the speaker obtained orders allowing her to continue serving.

Wrangles in County assemblies have been rampant thus calling for different leaders’ intervention with ODM leader Raila Odinga holding talks with Kisumu MCAs.

Recently, the MCAs told off senators on their county matters.
