DPP reveals damaging effect of ties with governor in murder case

Lots of Kenyans are looking for justice with little hope in the judiciary but with rise of fierce Noordin Haji who has been fighting corruption relentlessly, light had returned except for a case where he is tied with the suspect that is now questioning his integrity.

Yesterday evening, the DPP responded to claims that he is a family friend to the Garissa Governor which may have altered the intensity of investigations in Mukhtar’s death.

Mukhtar, the former Garissa Finance executive, was shot on August 19, 2018 at White Star Restaurant along Kandara Road in Kileleshwa, Nairobi.

The Director of Public Prosecutions (DPP) Noordin Haji has rubbished claims of failing to act in the case where Garissa Governor Ali Korane is accused of alleged involvement in the shooting of Idris Mukhtar.

Haji acknowledged that Korane is indeed an acquaintance but was categorical that it is not of consequence since he took an oath that pledges justice for all.

“I have said it very clearly, when it comes to murder I will not entertain it and the law has to take its course. When the file is brought to me, I will take the appropriate action based on the evidence that I have before me,” Haji said.

Speaking during an interview on Citizen TV’s News Night, Haji insisted that his decisions on cases are purely based on evidence and not on individual bias.

“I cannot manufacture evidence, it has to come from the DCI who is the person in charge of investigations,” said DPP Haji.

Earlier in the month, the family of Mukhtar came out accusing Haji and the Director of Criminal Investigations (DCI) of not investigating the case further.

“We do not have faith in the DCI, he has been influenced by some politicians,” the father, Aden Mukhtar, said.

According to the family, Mukhtar is still in a coma and was flown to India for specialised treatment.

David Mwai, who was suspected to have been the man captured on CCTV shooting Idriss at close range, died  while in a cell at Parklands Police Station and, though police sources pointed at suicide, the family thought otherwise.

Mr Mwai’s sister Esther Wanjiru is the last family member who spoke with him before his death.

The family of the late Mwai called on the DPP to open investigations into how he died at the police cells.

“I suspect that there is some foul play,” she told the Saturday Nation, accompanied by her aunt Ruth Kibugi. “My brother called me on Wednesday while in police cells and told me that some people had promised to bust him out of the cells, but I discouraged him,” she said.

Ms Wanjiru said that her brother, a 28 year old father of two, had confessed to the crime. “He told me that he did it. I advised him not to take any other extra-legal option that he was being promised. I told him to let the law take its course,” she said.
