This year in January, Lawyer, Apollo Mboya filed a class action suit over higher bills amounting to Sh8.1 billion for the months of November and December 2017. In his action suit, Mr. Mboya wanted the High Court to declare that Kenya Power made a false and misleading representation in electricity tariffs and bills and was therefore infringing on the rights of consumers.
“Kenya Power is illegally imposing inflated bills…” said Mboya.
Today, the Former Chief Executive of the Law Society of Kenya, Apollo Mboya and Kenya Power agreed to an out-of-court deal in the case filed against the company over the inflated electricity bills. As part of the deal, Kenya Power has said that it will stick to the tariffs approved by the Energy Regulatory Commission and set up billing query centers around the country.
The Kenya Power and Lighting company has now given customers 30 days from Monday to raise billing complaints adding that the company will not disconnect supply to customers who raise issues regarding their bills.
Kenyans however, now feel let down and betrayed by Apollo Mboya for agreeing to settle the matter out of court.

I don't want to say that am disappointed with Apollo Mboya but news that "Kenya power and him have agreed for an out of court settlement over billing" has made me sad. I thought those affected with billing were "we", the Kenyans and not Mboya alone, (whom I respect).

The electricity distributor, Kenya Power, also agreed to pay costs of filing the suit to Mr. Mboya and the Electricity Consumers Society of Kenya.
Mr. Mboya, however made contradictory remarks about the very company he agreed to have out-of-court discussions with.
