Reprieve for Key ODM MP as Court Withdraws Case Against Him

Makadara MP George Aladwa and former Machakos Senator Johnson Muthama on Tuesday, January 18, got a reprieve after a Milimani Court withdrew hate speech charges against them.

Chief Magistrate Francis Andayi, in his ruling, indicated that the decision was informed by the 2017 High Court ruling that declared section 96A of the penal code unconstitutional.

Aladwa and Muthama were arrested and charged over alleged ethnic hatred and incitement to violence in 2015.

In the case, the ODM legislator allegedly made hate remarks during a rally on Mashujaa Day over the outcome of the 2017 general election.

Muthama, on the other hand, was accused of making inflammatory utterances during a political rally at Uhuru Park.

The ex-Senator had questioned the government’s commitment to deal with the 2015 Ksh791M National Youth Service scandal.

It was alleged that his remarks were disrespectful to President Uhuru Kenyatta and the then Devolution Cabinet Secretary, Anne Waiguru.
