Why State Want Babu Owino Re-arrested

Embakasi East Member of Parliament Babu Owino is still in trouble weeks after securing his release on bail.

The state is now seeking to have the bail terms granted to the youthful lawmaker cancelled.

The Director of Public Prosecutions had earlier on faulted bail terms issued by a magistrate’s court in freeing Babu Owino.

The state now wants the terms reviewed on grounds that there was no fixed cash bail deposit.

The state also argues that there were no fixed sureties in the bond terms issued, and therefore, Babu was released without any cash bail or any surety.

The money that Babu Owino is supposed to deposit in Court is supposed to go for the medication of his shooting victim, DJ Evolve.

Justice Luka Kimaru will make the ruling on the application by the state on February 27, 2020.

Should the state win in its application, the controversial MP will be rearrested.

However, Babu Owino’s defence team led by Lwayers Danstun Omar and Cliffe Ombeta argue that what is before the court is the insensitivity of the state, not taking up the life of the victim very seriously.

The MP who is charged with attempting to murder Felix Odhiambo Orinda (DJ Evolve) was released on a Sh10 million cash bail to be paid in installments and channeled towards the victim’s hospital bill.

Trial magistrate Francis Andai ruled that the MP shall meet the initial medical expenses of the victim and to this end up to the value of Sh10 million, an amount he said was equivalent to the value of cash bail the court had set for him.
