Mutula Jr schools Murkomen on Kiambu governor swearing in

Makueni Senator Mutula Kilonzo Junior has taken Senate Majority Leader Kipchumba Murkomen through some lessons on the swearing in of a Deputy Governor.

On Thursday morning, Murkomen cried foul over a move to swear in Kiambu Deputy Governor James Nyoro as the new governor barely hours after Waititu’s impeachment.

Murkomen argued that the move by the Judiciary to dispatch a judge to preside over the swearing in ceremony was wrong.

According to the Elgeyo Marakwet senator, the swearing in of Nyoro should happen after 10 days from the time  Waititu was impeached.

He argues that the ceremony can also not happen before the date, time and place for conducting the swearing in Ceremony are gazetted.

“A High Court Judge cannot preside over swearing in of DG of Kiambu to be a Governor before 10 days are over and before they Gazette the date, time and place for conducting the swearing in Ceremony. But you know what ? Everything is working like a clock in the new Kenya,” argued Murkomen.

But while responding to his arguement, senator Mutula Kilonzo Junior had to school his learned friend a bit.

He said that Murkomen was part of the team that approved the bill he had quoted in reference to Assumption of office after a General Election.

Murkomen was reminded that a vacancy had occurred in Kiambu under Article 182 of the Kenyan constitution and the deputy shall assume office under Article 182(2).

“Boss , you and I approved this bill in reference to Assumption of office after a General Election. In Kiambu, a vacancy has occurred under Art 182 and the deputy shall assume office under 182(2). Needless to say , I agree with you that we are back into a working nation,” Mutula said.

Murkomen however had to defend his point by referring to section 3 of the quoted Article of the constitution.

“Sec.3, The provisions of this Act shall apply — (a)to the assumption of the Office (b)with necessary modifications, to the assumption of the Office of the County Governor by a deputy county governor or a speaker of a county assembly under Article 182(2) and (4)of the Constitution,” he responded.

Nyoro’s swearing in ceremony is currently underway with embattled Waititu in Court to stop the event.
