One Thing That May Save Waititu From Senate Impeachment Motion

An embattled Governor of Kiambu County Ferdinand Waititu may survive an impeachment motion on the floor of Senate-Assembly if one key factor is proved beyond doubt in his case.

According to Lawyer Dunstan Omari, who spoke to Citizen Tv, the fact that Waititu’s lawyer dodged the charges pressed against the Governor to question the process of his impeachment at the County Assembly could vindicate him from the looming ouster.

“If you go to court to press charges against someone for breaking the law, then you must follow the law.

“Waititu’s lawyers have been so brave, instead of answering corruption charges that Waititu and his wife stole monies and grabbed land, they opted for poking holes at the processes of impeachment,” said Omari.

The lawyer further added that failure for Kiambu MCAs to follow crucial legal stipulations, specifically that of a requisite quorum required for an impeachment motion to go through, will hamper the impeachment process given that the law requires a strict adherence of each process.

He further faulted Kiambu MCAs for breaching required processes in their push to oust the Governor saying their move was in a way seeking alternative institution they can blame for their failures.

“To oust a governor you must follow the law, do they know that that a threshold of impeaching a governor is two-thirds of the MCAs of a given county assembly? When someone says that the MCAs were 57 and the threshold is 67 that case is already defeated.

“According to me, Waititu had already planned how to save himself and those who took him there are only shedding crocodile tears.

“They want to create a case where they will blame the Senate or the court for letting Waititu go when they know very well that they failed in the first step,” added Omari.

It is not clear yet the exact number of people in the assembly since it was reported that 63 MCAs voted during the impeachment case.

According to media reports,  63 MCAs voted in support of the motion tabled by Ndenderu MCA Solomon Kinuthia who, among other issues, accused the embattled county boss of gross misconduct and abuse of office.

Only one MCA voted against the motion while 28 were absent, thus, the motion met the required two-thirds majority threshold.

The impeachment motion is set to be heard on Tuesday and its determination will be done on Wednesday.
