Lawyer Kipkorir Defends Haji’s Move to go After Governor Over Bail Terms

A day after Director of Public Prosecutions(DPP), Noordin Haji, said he had called for the cancellation of Samburu Governor, Moses Lenolkulal court bond, a Nairobi city lawyer on Saturday came in to back up his decision.

Donald Kipkorir, besides him being a lawyer is also known for his flamboyant lifestyle, strongly believed Lenolkulal had breached his bail terms hence his bail ought to be cancelled.

Taking to his twitter account Kipkorir said, “his bail(Lenolkulal) ought and must be cancelled. In reshuffling his Cabinet or presiding over any function, Samburu Governor Moses Lenolkulal brazenly violated his bail terms.”

He further went ahead to explain what being barred from office meant, “in law, “Office” is the duties, powers, responsibility, allowances and benefits attached and not a physical structure.”

“You didn’t see that ridiculous order by the magistrate in the Sonko case the other day? How can a magistrate stop Sonko from appointing a deputy as a term of his BAIL?

“Obviously the magistrate was called by the executive via Judiciary channels and ordered to include that, ” Ahmednasir said.

In response, Kipkorir said that one did not need to be a lawyer to google the meaning of office in law.

“Once you make an order barring one from office, the order is all-encompassing. To expound the order is to engage in the ridiculous as you state.”

On another case, DPP Haji is expected to give direction on the fate of Nairobi Governor Mike Sonko over assault on a senior police officer in the Coast region when he was being arrested for corruption charges.

Police in Taita-Taveta County yesterday said they had forwarded the file recommending assault charges against the governor to the DPP for action.

“We are waiting for direction from the DPP and we have our own file here for action,” County Police Commander Said Mohammed Kiprotich said yesterday.

Authorities said the governor could be taken to Voi to answer the new charges.
