Humphrey Kariuki Dealt New Blow After Court Issues New Order

Businessman Humphrey Kariuki was on Wednesday dealt a blow after a new order was issued by the courts.

It was reported that the Magistrate Court had reversed the travel order that had been granted to Kariuki to travel abroad.

The court went back on the earlier verdict due to the pending hearing of the Ksh41 billion case against the tycoon.

On Thursday last week, Milimani Senior Principal Magistrate, Kennedy Cheruiyot, had directed the release of the travel documents after the court observed he had presented himself to the DCI voluntarily.

“I find that the accused person presented himself to the Director of Criminal Investigations (DCI) when required to do so even though he was out of the country at the time,” remarked Cheruiyot.

The senior magistrate reiterated that the court respected the constitution requirement where a citizen is innocent until proven guilty.

“In the context of constitutional requirement of presumption of innocence, I find no reason why Kariuki’s personal business engagements should be restricted,” pointed out the judge.

Cheruiyot had also highlighted that the court could not deny the billionaire the right to travel abroad as there was no objection from the prosecution on the matter.

Kariuki, through his legal representative, Cecil Miller, had filed a petition to seek to regain possession of the passports.

Miller had assured the court that his client would always avail himself when required to.

“Mr Kariuki exhibited good conduct by surrendering himself to the DCI when he learnt that he was required to record a statement and eventually be charged,” stated Kariuki’s lawyer.
