City Lawyer Ahmednasir Abdullahi attacks DCI over Judge arrest.

Renowned Senior Counsel Ahmednasir Abdullahi has scolded the office of the Directorate of Criminal Investigation(DCI)) after they arrested a Principal Magistrate over reckless handling of exhibits.

The lawyer took to his tweeter handle to question the basis of the arrest pitting Magistrate Edgar Matsigulu Kagoni.

According to the lawyer’s post, ostensibly, magistrates should not be faulted for anything that happens during the trial.

“What does this mean…”reckless handling of exhibits…” can a magistrate be arrested for what happens in court during a trial?” he asked.

The lawyer, who isn’t new to controversy, claimed that Kenya’s Magistrates were vulnerable to unlawful victimization due to inadequate protection.

“With a pro-government JSC and a CJ who doesn’t stand up/speak for his judges who will speak for “judicial decisional independence” of judges/magistrates?” asked the lawyer.

The remarks come barely a half a day after the office of the DCI said, on Saturday, they had arrested five people in connection to impetuous handling of the exhibit.

About the incident, the DCI tweeted: “Following the reckless handling of Exhibits that led to the loss of approx. 10 Kgs of Heroin valued at Ksh. 30M & Cash of various currencies valued at over Ksh. 600K, @DCI_Kenya Detectives have today arrested FIVE People – including the Principal Magistrate at Mombasa Law Courts.”

According to the DCI, the incident happened in July 2018.

Others arrested include Mr Abdalla Awadh Abubakar, Mr Lawrence Thoya Bayan, Mr Onesmus Momanyi.

The suspects are currently in police custody and will be charged with: “Obstruction with Intent to defeat Justice as well as Aiding and Abetting Trafficking in Narcotic Drugs.
