Naftali Kinuthia’s bail ruling bears no fruit again

Image result for Naftali KINUTHIAThe sole suspect in Ivy Wangechi murder case, Naftali Kinuthia, will remain in custody until the High Court rules on his bail application which has been scheduled on June 17.

The bail application was first was postponed from May 9 and set for hearing on 27 May.

The office of the DPP’s office and the victim’s family’s lawyers have opposed any decision to have him out on bond arguing that he may interfere with witnesses or run away.

However, Naftali Kinuthia’s lawyer Mbiu Kamau argues that bail is a right incorporated in the Constitution and it can not be denied unless there are compelling reasons to do so.“He can only be denied bail if he admits to being guilty, the court finds him guilty or the Constitution is amended to provide for denial of bail,” the lawyer said, terming the grounds advanced by the prosecution as flimsy. Naftali was first charged On April 30 before the High Court in Eldoret for allegations of murdering Ivy Wangechi, a 6th-year medical student at Moi University on April 9 in Eldoret town.

He pleaded not guilty to the murder offence when he appeared before Justice Githinji.

Police have lined up 10 witnesses against Naftali in the murder of Wangechi.

Last month, Eldoret Senior Resident Magistrate Nichodemus Moseti ordered Kinuthia to undergo a psycho evaluation to determine whether he is fit to stand trial. He may opt for the manslaughter charge which bears a more lenient sentence if found guilty.
