LSK beefs government for ignoring court order on Housing Levy

The Law Society of Kenya (LSK) has criticized the government for ignoring a court on the Housing Levy.

This is regarding an order issued on April 16 ordering employers to deduct 1.5% of salaries to be channeled to the housing levy starting May.

LSK President Allen Gichuhi however on Friday called out the government for defying a court order that declared the housing levy not be effected until the case is fully determined.

The court set the hearing date for June 25.

“The court, in a ruling delivered on April 29 by Justice James Makau, granted conservatory and injunction orders prohibiting the respondents from effecting the housing levy pending the hearing and determination of the case in court,” Mr Gichuhi said.

“It is illegal, improper and an affront to the Constitution for the ministry to purport to effect payment of said levy in the prevailing circumstances,” he added.

Politicians such as Nairobi Governor Mike Sonko and Machakos Governor Alfred Mutua similarly expressed their opposition to the Housing Levy.

“A big percentage of wakenya ni maskini sana na those employed wanapata mapato ya chini sana. I will be looking for HE the President when he comes back next week and try to address this issue with a lot of humility for this housing levy ya kunyanyasa wakenya to be suspended and withdrawn,” Sonko posed at a church.

“There should be no new taxes. Taxes on essential commodities and activities such as food and transportation, cost of fuel, cost of power, and many others should be reduced and not taxed more. Kenyans are tired,” Mutua on the other hand said at a separate gathering.
