DPP Gives Reasons For Withdrawing Lawyer Assa Nyakundi’s Case

The Director of Public Prosecution (DPP) Noordin Haji has defended his decision to review criminal charges against City Lawyer Assa Nyakundi.

In his response to the application by Nyakundi’s wife Lydia Kung’a, the DPP said the applicant was a prosecution witness and cannot dictate review of the charges.

Lydia had opposed the DPP’s bid to withdraw the charges arguing she was never consulted and the court should revise the decision.

She further blamed the prosecution for disclosing her names and that of her son to the public listing them as state witnesses.

The DPP further said that the manslaughter case against Nyakundi was withdrawn.

He argued that the application had no legal or factual basis and should be dismissed.

The Director of Criminal Investigations George Kinoti had earlier disowned a manslaughter charge against Nyakundi.

Lawyer Assa Nyakundi is accused of killing his last born son last month.

According to Kinoti, the two senior officers alongside two prosecutors allegedly engaged in a ‘cover up’ attempt of the murder.
