The Director of Public Prosecutions (DPP) has opposed an application by the Defense to have Justice Jessie Lessit disqualified from a case where Migori Governor Okoth Odado, Michael Oyamo & Caspal Obiero are charged with the murder of former Rongo University Student Sharon Otieno & her unborn baby.
In their application, Defense through lawyers to Michael Oyamo and Caspal Obiero said that the Hon. Justice was biased in granting bail to Obado & in-turn denying them.
Oyamo and Obiero argued that the fact that Governor Obado is more influential means that he was likely to interfere with witnesses as compared to them. They have found issue with the fact that Obado was freed despite wielding so much power yet they were detained up until an appellate Court heard their pleas and let them free on bond.
Oyamo & Obiero therefore want the case to be heard by a different Judge.
DPP through Deputy Director Jacob Ondari opposed the application saying that the reasons given by the Defense did not meet the basic test to disqualify a Judge.
The case will be heard on 29th May 2019.
