Top lawyer Nelson Havi has questioned the narrative that Evans Kidero authorized the defense of a fictitious case in 2010 and payment of fees to the Advocate on 13.6.2011.

Further that he did all these before he was elected Governor Nairobi County in March, 2013?. “Someone is playing games with our taxes! ,” he has declared.

Former Nairobi Governor Evans Odhiambo Kidero has been arrested over irregular payment of Sh 68 million to a law firm.

Kidero’s Former Chief of Staff George Wainaina and former Councillor Paul Mutunga have also been arrested

Ethics and Anti-Corruption Commission (EACC) officials said they had been investigating the three individuals for irregularly paying legal fees to M/s Wachira Mburu, Mwangi and Company Advocates.

“Investigations established that one Steven Kariuki from the firm M/s Wachira Mburu, Mwangi and Company advocates was given instructions by Aduma Joshua Owuor – former acting Director Legal Affair of the then Nairobi City Council and now MP Nyakach Constituency to act on behalf of Nairobi City Council in HCC No.875 of 2010 Kyavee Holdings Limited versus City Council of Nairobi, without following the laid down procedure,” EACC said in a statement.

According to EACC Kyavee Holdings Limited never existed and therefore, had no legal capacity to sue the county.

“The advocate representing Kyavee Holdings Limited did not possess a valid practising certificate at the material time,” EACC said.

Further, the probe revealed that the disputed land was Mariakani Primary School’s playground and had not been re-allocated to anyone.

With no services offered, the money was paid in two installments of Sh 10 million on June 13,  2011 and another of Sh 58 million on January 7, 2014.
