Kisii Court charged two for having canal romance with a disabled cow

A court in Kisii on January 2019 charged two gentlemen for having sex with a cow against the order of the nature.

Evans Nyagweso and Edgar Omweri pleaded not guilty to the first count of unnatural offense contrary to section 162 (a) of the penal code.

According to the charge sheet, the accused, all residents of Boikanga Village in Gucha South within Kisii County unlawfully had canal knowledge of a cow against the order of nature.

The two were further accused of injuring the cow while having sex contrary to section 339 of the penal code.

They were further accused of killing the animal valued at 50,000.

The court released them on a cash ail of sh 50000 or an alternative ond of sh 150,000.

Bestiality under the Kenyan law is provided for in the Penal Code under sections 162 (b) and 163. Section 162 (b) of the aforementioned statute provides that any person who has carnal knowledge of an animal, is guilty of a felony.

The constitution states that if one is found guilty he/she is liable to imprisonment for fourteen years.

Section 163 provides that any person who attempts to commit any of the offences specified in section 162 is guilty of a felony and is liable to imprisonment for seven years. However the Penal Code does not define the term bestiality.

Courts in Kenya have handled various cases dealing with bestiality and have taken the approach that there must be penetration for the offence of bestiality to be established.
