Lawyer Nelson Havi was reprimanded by the court on Thursday for attacking the Director of Public Prosecutions on social media.
The 5 judge bench hearing the petition by Deputy Chief Justice Philomena Mwilu said that Mr Havi attacked the DPP without evidence.
Havi was reprimanded for accusing the DPP of paying bloggers to spread false information about DCJ Mwilu.
Justice Hellen Omondi said that it was important for Counsel to conduct themselves with decorum and respect for the legal profession while expressing themselves on social media.
This happened during DCJ Mwilu’s case where there was a bitter exchange of words between Queen’s Counsel Khawar Qureshi and defence lawyers on the second day of the petition by DCJ.
One of the lawyers while lifting a copy of the constitution told Qureshi “this is a sovereign country. If you are not happy here, go back to your country!”
Appearing before Justices Helen Omondi, Mumbi Ngugi, Francis Tuiyot, Chacha Mwita and William Musyoki, Qureshi argued that DPP Haji followed the law when he decided to indict the DCJ.
Qureshi asked the bench to dismiss Mwilu’s petition on grounds that she wants to turn the proceedings into a criminal trial.
The Queen’s Counsel stated: “The petitioner wants to turn this court to a criminal court.”
He also told the court that DPP Haji acted with a lot caution having first approached Chief Justice David Maraga with the issue.
