James Orengo on the other side stated that the constitution had clear provisions on impeaching the Deputy President.

According to the constitution, deputy president can be removed from office through provisions under Article 150 (1) (a) and (b) (i) (ii) and (iii) of the Constitution of Kenya.

Article 150 (1) (b) (iii) of the current Constitution of Kenya states a deputy president may be removed from office for gross misconduct. Lawyer Miguna Miguna argued that ODM lacked numbers to sustain an impeachment motion against DP William Ruto in Parliament.

Orengo was backed up by Kakamega Governor Wyceliff Oparanya, who said that DPs impeachment would provide a conducive environment for Uhuru and Raila to fight corruption citing Ruto as an barrier to war against graft.

The leaders accused Ruto of impending war against graft through intimidating public institutions mandated with fighting corruption

The Opposition party’s leaders including Senators James Orengo, Ochillo Ayacko (Migori), Kakamega Governor Wycliffe Oparanya and ODM Secretary General Edwin Sifuna announced they would marshal support from their Jubilee counterparts to ensure Ruto is kicked out of office before 2022.

Speaking in Ugenya where they led campaigns for Chris Karan, the ODM candidate for the area’s vacant National Assembly seat on Monday, March 25, the leaders alleged the DP had violated the law thus did not deserve to remain in office.

“We will push for his removal on grounds of gross misconduct. The cutoff requirement to oust a DP according to the Constitution is lower than a criminal trial prosecution,” Orengo said.

Ayacko argued that Ruto’s verbal attack on the Directorate of Criminal Investigations (DCI) over its role in investigating graft allegations surrounding the KSh 65 billion Kimwarer and Arror dam projects amounted to obstruction of justice, thus tantamount to gross misconduct.

“The DP’s obstruction of justice is a criminal offense and we need to speedily tame him from intimidating institutions mandated to fight corruption,” said Ayacko.

Oparanya argued the move was aimed at helping President Uhuru Kenyatta and Opposition leader Raila Odinga to sustain the war against graft with Sifuna stating Opposition MPs were working on the impeachment motion to commence the ouster in the shortest time possible.

Combative lawyer Miguna Miguna however, poured cold water on ODM’s plot to impeach Ruto saying Raila’s party lacked capacity and proper grounds to make their threat true.

He added that the Opposition lacked numbers to successfully push the anticipated impeachment motion. “They neither have the numbers to win in Parliament nor the constitutional and legal basis to sustain a Supreme Court challenge,” explained Miguna.
