Supreme court jails two terror suspects

There was tight security at the Supreme Court on Friday afternoon as judges delivered judgment for two Iranians who were suspected terrorists.

Armed police officers were seen walking through the corridors of the apex court as Justices Jackton Ojwang’ and Mohammed Ibrahim delivered the court’s final judgment.

The highest court ruled to enforce a 15 years jail sentence for Ahmad Abolfathi Mohammed and Sayed Mansour Mousavi who were arrested with bomb making materials back in 2012.

The two were arrested after they led police to a spot where RDX explosives were discovered.

The Court of Appeal had overturned an earlier ruling leading to their release from custody but the Director of Public Prosecutions appealed the appellate court’s decision at the Supreme Court.

Through their lawyer, Senior Counsel Ahmednasir Abdulahi, the two had argued that it is not the duty of an accused person to aid police with their investigations.

“The burden of proof does not shift at any point in criminal cases whether the accused persons talk or not. The prosecution must discharge the burden,” he stated.
