In his directive, Magistrate Kenneth Cheruiyot said that the court was convinced that the official was aware of the existing court orders and deliberately decided not to comply.

According to the firm, Ngunyo has disobeyed the orders that were issued early this year. He is expected to appear in court next Tuesday, March 12, 2019.
Through lawyer Paul Muite, the court heard that when the orders were issued to have the fertiliser to be re-tested, the parties involved in the case flew to Mombasa for the exercise, but the MD was absent thus halting the exercise.
Muite also submitted that the Prosecution initially conducted the testing of the fertiliser in the absence of the accused and stated that it should jointly be carried out the testing to evaluate the validity of the evidence held by the prosecution.
