Emotions fly high with some writing poems to express disappointment in postponement of gay case ruling

Nairobi’s packed Milimani High Court, Room 1, 3rd floor, was packed with many awaiting history to be made today in the fight for LGTIQ rights in Kenya.

Activists in their challenge of laws criminalizing homosexuality waited for the postponed verdict anxiously.

The anxiety has however been added more days all the way to May as Justice Chacha Mwita revealed some of the judges in the case were busy thus the judges have not finalized making their decisions . He added that the challenge also involved the huge volumes of file sent to the three-judge bench in soft copy .

“You may not like the news I have today…one of our colleague is still on leave,” Justice Mwita said as he apologised on behalf of the bench to the parked court room.

The case, seeking to abolish laws that criminalize homosexual behaviour, was filed by the National Gay and Lesbian Human Rights Commission, and the Gay and Lesbian Coalition of Kenya.

The group wants section 162 and 165 of the Kenyan penal code scrapped off arguing it validates stigma, discrimination and violence towards LGBTQ+ persons.

Since the postponement of the ruling many have expressed their much disappointment with some saying they have been waiting for this ruling for over three years.

Others chose to construct poems in their expression after the court failed them.

“To say we are disappointed is an understatement”, others added.
