Court stalls LGBT case for months

Kenya’s LGBTQ+ community will now have to wait for another 91 days before the court can hear out their plea to abolish laws that criminalise homosexual behavior.

Justice Chacha Mwita on Friday moved the widely anticipated ruling to the morning of May 24.

The National Gay and Lesbian Human Rights Commission, and the Gay and Lesbian Coalition of Kenya filed a case wanting section 162 and 165 of the Kenyan penal code scrapped off arguing it validates stigma, discrimination and violence towards LGBTQ+ persons.

Judge Mwita told the packed courtroom that the reason behind the postponement was due to the absence of one of her colleagues.

“You may not like the news I have today,” she said, “one of our colleague is still on leave.”
