Distressed Karua now insinuates that Waiguru had inside information of the ruling

Narc-Kenya leader and prominent Kenyan lawyer Martha Karua is not one to give up easily. Described by many as the ‘iron lady’, Martha Karua is not taking lightly the Court of Appeal’s decision to dismiss an appeal she made challenging the election of Kirinyaga Governor Anne Waiguru.

Following the ruling made today Justice Gatembu Kairu, Karua has in a tweet insinuated that Governor Waiguru had inside information of the outcome of the case seeing as she came to court prepared for victory.

 

 

“For a respondent who never came to court during hearing ,but comes to court for judgement complete with a battery of media in tow and a celebration party , leaves one wondering whether she was aware of the outcome,” said Karua in a tweet.

On the other hand, Waiguru in a tweet seemed to mock Karua with scripture after her election was upheld by the court.

 

“What, then, shall we say in response to these things? If God is for us, who can be against us?”Rom8:31 – Thus says the Word of God,” Waiguru tweeted.

The judges ruled that the appellant, Martha Karua has to prove her case beyond reasonable doubt on claims that there was bribery in the Kirinyaga gubernatorial election last year.

“There was no prejudice suffered by the appellant in failure by Independent Electoral and Boundaries Commission (IEBC) to produce the Kenya Integrated Election Management System (KIMS) kit,” the ruling read by Justice Gatembu Kairu said.

The court had however noted that the appeal raised matters of law and therefore rejected submission by Governor Waiguru and IEBC that the appeal was not properly before them.

According to the Appellate judges, Waiguru’s legal team did persuade them that the judge was biased in rejecting the application for recusal. They further ruled that the High Court erred in law by limiting the appellant from using forms that were in possession of IEBC.

In June 2018, the the Kerugoya High Court dismissed Karua’s petition challenging the election of Governor Waiguru. Judge Lucy Gitari threw out Karua’s petition on grounds that it lacked merit and ordered her to pay costs amounting to Ksh. 5 million; Ksh. 3 million as cost of the petition and Ksh. 2 million to the IEBC.

Karua he vied for the Kirinyaga gubernatorial seat during the 2017 General election but lost to Waiguru who garnered 153,353 votes.

Speaking after today’s ruling, Waiguru said she was happy that the court had ruled in her favour adding that justice had been delivered.

“We are very happy because we know we won the election. We hope she doesn’t go to the Supreme Court, but if she does it is her constitutional right,” she said.
