NEW JUDGE TAKES OVER MARIBE AND IRUNGU CASE

High Court Judge, James Wakiaga is today presiding over the murder trial of Jacque Maribe and Jowie Irungu over the murder of Monica Kimani. Justice Wakiaga is expected to hear the bail application after Judge Jessie Lessit directed that the case be heard by a different judge.

The two, Miss Maribe and Mr. Irungu appeared in Court on Monday, 15th October to take plea over the murder of Monica Kimani who was murdered in her apartment in Nairobi’s Kilimani area.

The prosecution had asked the court not to grant Maribe and Jowie bail on grounds that if released, the two may interfere with the ongoing investigations. According to investigating officer, Mr. Maxwell Otieno, the residence of the late Monica Kimani and Miss Maribe are primary and secondary crimes scenes respectively.

The High Court has now set the bail hearing for Maribe and Irungu for October 24th 2018. Justice Wakiaga said he will get a report from the probation officers.

“Probation officers should prepare and submit pre-bail report.” he said.

Citizen TV Journalist is now fighting for bail arguing that her staying in remand is putting the welfare of her 4-year old son Zahari in jeopardy. Jacque who is a single mother is primary care-giver of her son.

“I was not involved in the murder, was not at the scene of the murder, and had no knowledge of (Monica) or any person known to her. Any association alleged against me with the murder is wholly weak circumstantial association with Irungu.” she said.

With the bail hearing pushed to the 24th of October, Miss Maribe and her fiance Mr. Irungu may have to continue being in remand at Langa’ata Womens Prison and Industrial Area Police Remand respectively.
