There’s a conspiracy theory going around that Justice James Wakiaga, the man who has taken over Jacque Maribe and Jowie’s case is fixated on releasing the two.
This is according to a section of Kenyans on Social Media who have read malice in the way the judge conducted himself on his first day in court.
The judge said he was an old school judge who does not like it when the media tries to influence a case before he hears it.
Judge Wakiaga said; “I am an old school judge who believes in blunt justice but when I am influenced before I hear the case I get very upset…We need to find out who is releasing information and these guys are here we need to know the source. Can they tell us who is giving them the information?”
He gave an order that the media does not let the freedom to information override subjudice in discussing a matter that is before court.
“Lets try to be kind to all of us because I’m the one who is likely to hear this matter and the information that you put out there will put me in a lot of difficult situation if I acquit these guys…The media is to guard against what to put in the public domain now that this matter is before court,” he said.
Blogger Robert Alai however said that Justice Wakiaga was trying to intimidate the media.
“But why is judge James Wakiaga more interested in gagging the media than presiding over the case? Anything he knows? Every court order must be backed by a clear reason and law supporting the same. Courts issues are not handled based on personal whims and feelings.” Alai said through his official Twitter handle.
Judge James Wakiaga comes out as biased and compromised. He should withdraw from the case. Trying to intimidate anyone with “I am old school” is archaic and belongs to the history bins. People will go to jail defending rights your honour.
