Court documents showing a Busia County man was charged with tearing his mother’s panty have gotten the attention of Director of Public Prosecutions (DPP) Noordin Haji.

The frivolous charge sheet made rounds on social media, raising suspicion among Kenyans, with many suspecting a cover up of something nasty or trumped up charges.

“Why would a court of law waste resources and time, charging a man for tearing his mother’s underwear?” wondered one Facebook user.

Apparently, Michael Omukule from Kwangamor, Teso South had stumbled upon his mother a fortnight ago night running in his compound.

So shocked was the 44-year-old man, he allegedly insulted and assaulted her and further scandalised her among his relatives and kin.

Omukule was also accused of blaming all mysterious deaths in the village to his mother and also accused her of being behind his father deserting the home.

While in court, Omukule denied physically fighting his mother and tearing her panty but accused her of practicing witchcraft, owing to some of the strange things that have been happening in their home, like being shunned by neighbours and some family members deserting the home.

Busia Senior Resident Magistrate, Martha Nanzushi told Omukule that even if his mother was a witch it was wrong for him to go public about it because it amounted to defamation, especially if he couldn’t provide hard evidence of the same.

“What I know is that my mother is practicing some witchcraft because my father deserted our home and moved to Benga where he bought the land. My brother did the same,” he said.

“I say this because I jumped out of my house in the middle of the night armed with a panga and torch after sensing that someone was running in our compound, I was surprised to learn that it was my mother,” said Omukule.

Omukule was to be charged at the Busia Law Courts for – among other crimes like assault – tearing his mother’s panty worth Sh100. However, after court documents went viral, the DPP has directed that the case be withdrawn.

But the prosecution has decided to charge Omukule with a fresh charge of scandalising his mother and defaming her by calling her a witch.

The initial charge sheet read: “You willfully and unlawfully damaged one inner pant valued Sh100 property of Wilbroda Barasa.”
