The five men accused of assaulting and robbing a Nairobi-based businessman have requested anticipatory bail from the court. They claimed that their personal security was at risk adding that they could be extra judicially eliminated.
They also say that if required for questioning or investigations by the police, they should be questioned at CID headquarters or Mazingira house in the presence of their advocates.
“The applicants are ready and willing to submit themselves to a just and fair legal system in which their fundamental rights and freedoms are respected and protected,” they say
They want the court to summon the DCI and IG to personally appear in court to show cause in the event disobedience of the order.
