Aukot, Linturi in a court battle over Ksh 2bn tender

A behind scenes deal between Dr Ekuru Aukot and National Transport and Safety Authority (NTSA) has escalated a battle between Aukot and Meru Senator Mithika Linturi. Two of Linturi’s firms, Atticon Limited and Ushindi Credit Limited, were among a consortium of 22 companies that won a Ksh 2 billion tender to supply new driving licences to NTSA in 2015.

Lawyer Aukot’s firm has been accused of fraudulently receiving cash on behalf of one of the companies after a behind the scenes deal. 

Linturi’s firms are both demanding Ksh80 million from Pesa Print, another member of the consortium. 

Pesa Print allegedly entered into a deal with Ushindi Credit Limited on the other hand, for the payment of Ksh30 million from the NTSA proceeds, emanating from the challenging of the award of the tender.

Pesa Print told the court that it had remitted Ksh20 million to Aukot’s law firm on behalf of Ushindi Credit Limited and planned to channel Ksh10 million through another firm, Symphony Technologies.

Linturi’s company denied that it had received any of the money alleged to have been paid. 

Pesa Print then wrote to Aukot’s firm accusing it of being an accomplice in a plan to defraud it. 

“There is a possibility that there was a conspiracy to defraud our client, and to unjustly enrich Ushindi on whose behalf you received money from our clients,” Pesa Print lawyers wrote. 

The letter was copied to the Directorate of Criminal Investigations as well as the EACC and Law Society of Kenya.
